DOES YOUR COMPANY HAVE A HEALTH & SAFETY APPOINTED PERSON?

Did you know, Under Regulation 7 of the Management of Health & Safety at Work Regulations 1999:

“Every employer shall appoint one or more competent persons to assist him in undertaking the measures he needs to take to comply with the requirements imposed upon him under UK Health and safety legislation.”

All employers should look to appoint one or more of their employees, with the necessary skills and training, to provide the Health & Safety guidance which is legally required. If the employer has no relevant competent employees within the organisation with respect to Health & Safety, then to comply with current health and safety law, the employer should outsource this to an external consultant or person within the relevant industry experience.

What exactly makes a person competent?

The Health & Safety Executives definition of a competent person is:

“someone who has the necessary skills, experience and knowledge to manage health and safety.”

Outsourcing the appointed person’s responsibilities to a Health & Safety consultant could save you time and money in not having to employ someone on a permanent basis or train existing staff. The health and safety consultant should work within your industry and has the necessary Health & Safety qualifications/ industry experience on current legislation and industry best practise
